Information required from you:

  • Read, and return a signed copy of our terms and Conditions and letter of authority.
  • Provide us with your current and any previous name and address.
  • Provide us with as much information and documentation regarding the accounts involved.
  • Advise us of any correspondence received from any of your lenders to able to advise you how to proceed.

Keeping you informed:

We will inform you in writing within 10 days of receiving any requests for further information from your lenders or when we receive updates or decisions or decisions on the progress of your claim. We will, as a minimum provide you with an update on your claim at least once in every 6 months.

Your right to cancel:

You, have 14 days from the date you sign and submit your claim to us at no cost to you .If you cancel after the 14-day cooling off period, a cancellation charge will apply at a rate of £50 per hour for the work undertaken. Any cancellation received after an offer has been made by your lender(s) will be subject to be invoiced at the rate equal to the fee due from the award. Initial PPI Checks:

Lenders have 30 days from the date of receiving our PPI information request to advise us if there is any PPI on the account(s).

PPI Claim:

Lenders have to respond to your complaint within 8 weeks of receipt. If they are unable to issue a final response within 8 weeks, they must send you a letter providing information on resolving your complaint.

Financial Ombudsman Service or the Financial Services Compensation Scheme:

Timescales may vary considerably should your claim be escalated to either the Financial Ombudsman Service or the Financial Services Compensation Scheme. Potential Risks in Making a Claim:

Payment Protection Insurance Explained

Payment Protection Insurance is designed to cover your loan or credit card repayments for a year in the event of you being unable to work due to an accident, sickness or unemployment.

 Although it was sold with credit agreements to protect both you and the lender in the event that you were unable to make your repayments, many people are paying for PPI and don’t have the protection they thought they had. For example, people with pre-existing medical conditions when taking out their cover may find that they are not entitled to claim on their policies despite having paid for PPI. Some self-employed people will also find that they have been paying for cover that is not actually suitable for them.

Single Payment Policies

Single premium PPI policies have been highlighted by the FSA as being unfair. You may be able to make a claim if you hold one of these and have paid off your loan early or had a change in your circumstances.

Payments for PPI will either be made on a month by month basis or paid up front for the whole policy covering the full duration of the loan agreement.

If you have taken a single payment policy, the policy premium would have been added to the loan and then interest would be added on top of it. This results in you borrowing the money to pay for the policy.

Where 8% Statutory Interest is awarded, this payment is subject to income tax which many lenders deduct at source.

Terms and Conditions (PPI Claims Management)

We aim to make the process as smooth as possible for you and to obtain a full refund of premiums paid, plus any interest that may be applicable.

By completing this complaint pack, you are agreeing to the PPI Claim terms and conditions as below.

You are aware that you could complain directly to the Company at no cost with the ability to take matters further with the Financial Ombudsman Service yet still wish to pursue your claim with Debt Advisory Services (Scotland) Limited (DAS).

These Terms and Conditions set out the Terms of Engagement for the appointment of “The Debt Advisory Service (Scotland) Limited” (DAS) (We), to act on the Client’s behalf in all aspects of the administration and negotiation of the Claim. Please read the terms carefully to ensure that You understand them before signing the Letter of Authority.

1. What we require from you

(a) By signing and returning The Terms and Conditions, the Client hereby agrees to be bound by the terms and appoints DAS to provide the services for such period as to allow them to assess and if reasonably possible to complete the Claim.

(b) By completing and signing the Letter of Authority, give DAS, his/her/their consent and full Authority to deal with the Company on the Client’s behalf and to obtain relevant information from whatever source on a continuing basis.

(c) To provide us with any relevant information or documentation which may support your claim.

(d) to promptly inform us of any relevant matters, (whether requested or not) which may impact on your claim.

(e) to advise us within 7 days of receipt by you or anyone acting on your behalf of any payment or offer of Compensation in respect of your claim(s) made by the Company, Financial Ombudsman Service or Financial Services Scheme.

(f) To advise us prior to starting your claim if you have ever been declared bankrupt, been subject to a debt management plan, Debt Arrangement Scheme, Trust Deed or any other formal or informal debt solution/arrangement.

(g) Give Debt Advisory Services (Scotland) Ltd (DAS) the right to deal exclusively with the claim unless otherwise agreed in writing by you and DAS

Failure to do so will give DAS the right to terminate this Agreement forthwith.

2. What you can expect from us

(a) We will rely on the information and documents provided by the Client to DAS as being true accurate and complete. DAS will not audit test or check such information or documents except where it has a legal obligation to do so.

(b) We will endeavour to obtain the maximum Compensation for the claims which are pursued.

(c) We will inform you, in writing within 10 days of receiving any requests for further information from lenders or when we receive updates or decisions on the progress of your claim. We will, as a minimum, provide you with an update on your claim at least once in every 6 months.

(d) carry out the Services with reasonable care and skill.

(e) We will take reasonable steps to safeguard against Your Information being accessed unlawfully or maliciously by a third party, accidentally lost, destroyed or damaged.

9. Limitations on our services and liability

(a) Where the Bank makes an offer of a Settlement Amount, we are under no obligation to verify the calculation of the amount other than to confirm that statutory interest has been applied by the Bank as required under the process rules of the Financial Conduct Authority.

(b) When an offer of compensation has been received from the lender, it will be the client’s sole decision whether to accept the offer as settlement of the claim. Should you decide to refuse the offer of compensation, you should advise us immediately so that we can advise the lender accordingly.

(c) If any form of tax is payable by You or on your behalf in relation to the Settlement Amount (such as income tax which is payable by You in respect of the interest paid to You as part of the Settlement Amount), You shall be fully responsible for such payment and We shall have no responsibility to make such payment on your behalf.

(d) We shall have no liability to You for any loss to the extent it arises as a result of the information provided by You in connection with your Claim being inaccurate or incomplete.

(e) DAS accepts no liability for any loss suffered by the Client entering into this Agreement and specifically, if no Compensation is paid to the Client by the Company. Any claim by way of consequential damage arising out of any act or omission or commission by DAS is specifically excluded.

11. Debt Management Plans, Trust Deeds and Bankruptcy

11.1 If you have a debt Management Plan in place, you may be able to proceed with your claim. However, your creditors may decide to offset any compensation against the debt you may have with them. If this is the case, you will still be liable for payment of our fee.

11.2 If you are in a Trust Deed or have been made bankrupt, we are not able to accept your case.

12. Security and retention of Your Information

Your privacy is important to us and we will keep Your Information secure in accordance with the General Data Protection Regulation. We will take reasonable steps to safeguard against your Information being accessed unlawfully or maliciously by a third party, accidentally lost, destroyed or damaged.

We also expect you to take reasonable steps to safeguard your own privacy when transferring information to us, such as not sending confidential information over unprotected email, ensuring email attachments are password protected or encrypted and only using secure methods of postage when original documentation is sent to us.

Your Information will be retained by us securely either electronically or in paper format for a minimum of six years, or if longer than six years as per the duration of this Firm’s relationship with you.

This agreement is a legally binding contract. By signing the contract, you agree for the Debt Advisory Service (Scotland) Limited to act on your behalf in respect of claiming back your mis-sold PPI payments. You are confirming that you have passed all the relevant documentation to DAS in respect of this/these claims.
